The water management approval represents the administrative act that conditions from a technical and legal point of view:
- The execution of projects to be built on water or related to water;
- Obtaining the permit for the exploitation of mineral aggregates from rivers and terraces;
- Approval of site-conditioning permit (PAT), general urban permit (PUG), as well as zoning permit (PUZ) and detailed urban permit (PUD) as long as they contain projects/works on water or related to waters.
The Process of obtaining the Water Management Approval
From a legal standpoint, obtaining the water management approval is regulated by Ministry Order 828/2019 approving the procedure and competences to issue, modify and withdraw the water management approval, including the Procedure for impact assessment of water bodies, the Norms for content for the technical documentation subject to approval and the content of the Impact Assessment Study on water bodies. This procedure regulates the procedural steps for issuance, modification and withdrawal of water management approvals, including the procedure for impact assessment of water bodies and competencies of its issuance.
The water management approval is issued after an analysis on the requirement of impact assessment on water bodies or, where appropriate, analysis of the Study of the impact on water bodies, by a commission established by the competent authority for water management.
The Process of obtaining the Water Management Permit
The water management permit is the act which conditions from a technical and legal standpoint, the operation and exploitation of new objectives built on waters or related to: surface waters, groundwater, coastal area, seafront, coast and sea beach, inland marine water, territorial sea, exclusive economic zone and continental shelf, and the operation and further exploitation of existing and, if necessary, carrying out the activity of storage, handling and/or transport using pipelines of dangerous substances or other activities on the ground or in the subsoil that can lead to indirect evacuation of dangerous substances in groundwater or surface water.
From a legal standpoint, obtaining water management permit is regulated by Ministry Order 891/2019 approving the Procedure and competences to issue, modify and temporary withdraw the water management permit, including the Norms for content for the technical documentation subject to approval. This procedure regulates the procedural stages for issuance, modification, withdrawal and temporarily suspension of the water management permit, as well as the competencies of its issuance.
The water management permit is issued on the basis of technical verification (on the field) of the compliance with the legal provisions regarding the water management for putting into operation the works and the accuracy of the information contained in the application and in the documentation annexed to it. For new developments, the verifications are carried out in the presence of the beneficiary of the works, preferably at the same time with the final reception of investments.
